I think that the point is that they abuse their power given to them and stretch what is written in the constitution beyond its ostensible intention. e.g. their own interests and the interests of special groups over the good of the people.

As a pipeline PM if we need to cross your land we send out “land men” to negotiate an easement with you. 99% of the time land owners are happy to see us. Noting like a surprise cash infusion to the ole bank account. I’ve only been involve in one condemnation in 20 plus years. Our final offer was $34K. We went to court and the judge awarded him $17k. It costs us $45k.

Moral of the story. Take the final offer just before the condemnation process. That is the max.

The govt will say that they can take your land or any private land. Whether or not they actually do it, is another question.

Many a moons ago, they were building this 2 lane road into a 4 lane and offered money to all the homeowners since they were going to cut into people's yard for the new road. I was a kid but I remember my dad saying that they pretty much had to take the counties offer or they would just take the land and we get no money. I think it was only a few hundred bucks at the time too.

Option for Difficult Owners

Here’s an idea that should work. Those that don’t want to sell get put on the Mexican side of the border. They can use ports of entry to go places in the US.

Might change some people’s desire to be difficult!!

The county built a road through my fathers land. Bought it for about 50 centas on the dollar. Per my father, this was 20 years ago.

He was obviously pissed.
