I didn't see any prints at the gallery. The artist is not famous at all. Basically a person who paints as a hobby but the art is striking and good and I believe has commercial value.

OK, but since I bought the original what can I do with it? Can I print it on t-shirtsa and so on? I believe the painting has potential to increase in value tremendously but the artist is a nobody who I believe just does this as a hobby or something to do. Like people who sketch and draw pictures. The art has potential.

Which means nothing in regards to who owns the rights.
I'm sure, that if you really wanted to own the image for commercial purposes, that you might be able to offer this not-at-all-famous artist some extra money to sign over all rights for the image that HE created.

Not unless you have permission.
Buying the original means nothing, as he could easily, and rightfully, paint three more of the same pictures tomorrow...or just have 1,000 reprographics made of the exact image you purchased.

Ok, I have to purchase reproduction rights or agree to a royalties deal. I get it. I may see about purchasing the reproduction rights and maybe buying the copyright. Some artists take a one-time fee instead of royalties. I may do that.

My dad is one and got popped by Louisiana Hot sauce for doing prints of it. He thought LHS was just a typical brand name. He paid LSU well when using their brand.

I purchased an original piece of art. It's a painting. I think it has potential commercial value as a print, poster, t-shirts, prints, and so on. I think I can market the painting on products and sell them.
Since I bought the original artwork at a gallery do I own the image to do what I wish with it? If I printed t-shirts or licensed it for commercial uses do I alone get the profits?
Unless you have in writing that you own the rights to distribute and profit from it. No.

It depends on the written agreement on the purchase. I bought the rights for a cover of my book but didn't spend the extra $80 for it to be exclusive. I would have owned it for $80 more.

I don't think you all understand...I own the painting, it'll be in the gallery until the end of the month but I own the picture, everyone liked it, IT'S STRIKING AND ORIGINAL!
