I’m going to guess there is a lot more to this story than what is in the OP. Like she had evidence of other employees being habitually late with no disciplinary actions.

Well, that's a hell of a "Retirement Plan". Work for a year, be late 47 times in that year, get fired for being habitually late, sue and win millions.

This was in federal court.
If you read anything other than the OP, you’ll realize Equinox fricked up every step of the way. This shouldn’t have even gone to trial, but they fricked up the pre trial settlement as well.
You can find various facts/quotes on page 2 about how they did nothing when she raised complaints of racism/sexism to management and they had swipe-in data that showed several other employees with worse attendance records, yet they were not similarly fired. This was utter incompetence by Equinox.

I have a friend who was late just as much as this woman and he was furious that he had to sign a letter stating that he would not be late anymore without a reasonable explanation....not even a doctor's note or something like that. I sat there just looking at him while he tried saying how unfair it was.

Equinox was clearly at fault here, but no way getting fired from a job for discrimination should result in a company paying $11MM. The penalty is way beyond what’s justified. That woman basically got lucky as hell and got her ticket to riches and financial freedom. I’d take that deal in a heartbeat

The judge agrees and ordered both parties to work with a magistrate judge to reach a settlement instead of drawing it out any more.
