I've heard of a few lawyers that can't pass the bar ending up at insurance defense firms as paralegals. I can't imagine a more miserable existence than having a law degree but having to eat shite from 1st year associates, partners and the insurance adjusters that send cases to the firm.

My wife and her law school pals all laugh at people who couldn't pass the bar first time or went to su law school instead of LSU or Tulane.

It's a way to keep lawyer #s down. A third of my class failed the bar--granted the exam was probably the toughest the state has ever given.
I wouldn't say it's stupid or pointless. Many of the people who failed shouldn't practice law to begin with. If you can't pass a test after 7+ year of college/law school and 3+ months of studying (with tutoring from the school/bar prep courses), then you should find another profession. And I have a ton of respect for people who take it a second time and pass.

How would anyone the public know a lawyer didn't pass in their first try? And other than perhaps the firm they were working for at the time of the failure, how would anyone in the profession know?

I have never once been asked by any client or peer about my bar exam or gpa. Nor has anyone I know.
