Arby’s might have some trouble on their hands after the women was found in freezer

I know the story has already been posted but some new information came out. It looks like the family is opening a law suit and has employees saying they have been reporting the broken freezer for 9 months.

Whoever is responsible at that arbys for putting in the maintenance request that just didn’t absolutely puckered up when they heard how this woman died.

I wonder if some of the employees were negligent as well or outright hostile to the manager. It seems hard to believe that she couldn't have found something metal to bang on the door and make enough noise for them to hear. Anyone know how Arby's are set up? Is the freezer far enough away from other parts of the store to make hearing someone an issue?

How does this not fall under worker's comp. Meaning this is a 75K case if she doesn't have any dependents.

Unless they can find fault against the manufacturer of the freezer potentially.

If there is evidence of reports of broken equipment that wasnt' handled by the company...sure.

If there is no evidence of any inspection logs of equipment...maybe could go either way from what I hear.

Only thing I've heard so far is employee's talking about the door being broken....if that's all they have to prove "gross negligence"...well I hope the family is happy with 75K to split amongst them all.

She’s the damn GM. The broken freezer not being repaired is on her.

That doesn’t mean the franchise wont settle.

If they were smart they would probably settle unless they have good records that the equipment was inspected and marked good for every period in recent history and have no legit record of a complaint being made about the equipment being broken and not fixed prior to this incident.

They would only settle to make it go away. She wasn’t a shift manager she was the GM. GMs are responsible for everything that goes on under that roof. (It’s why GMs are often named in lawsuits as a defendant)

In this case the GM would be responsible for reporting and making sure that repairs are completed and the building is safe for employees and customers.

The only defense is if she continually reported it to the franchise owner and the franchise owner continued to kick the cam down the road.

The news cast I saw this morning said that multiple work orders had been submitted up the chain of command. The way they worded the report made it sound like there was a paper trail of the request.
