I would not have apologized. You gain absolutely nothing by bending the knee to them. You will still get sued, they will still boycott your business, and the people who would have patronized your restaurant for having balls and not apologizing...won't respect you at all. It's a no win situation. Call their bluff, say you did nothing wrong and lawyer up. frick em.

If someone at a restaurant is not capable of actually taking a name down or have some sort of numbering system for orders, things like this can happen.
