Meanwhile, new construction is painting the brick. I even got the exact color from the builder and was still rejected.
I had an issue with these people getting approval for an infinity pool.
It took 4 tries to get my pool approved because it had an infinity edge and was unlike others in the neighborhood...not kidding.

Just do it. They don't have absolute authority to selectively enforce. If they try to fine you, tell them to frick off. If they escalate it, get on legalzoom and have them send a letter.

I'm on the HOA board in my neighborhood of almost 200 homes. The horror stories I hear on this board are just crazy. We just use good judgement on things and haven't had too much of an issue. Wanna paint your house? Sure just don't paint it hot pink and it will be fine. We are nothing like the HOA's i hear on this board.
OP, I have no idea why they are trying to restrict something INSIDE your house. We have never done something like that.

When I say “HOA Attorney”, I just mean an attorney who has experience dealing with HOAs.and the laws that govern them.

Some people just don't want to be told what to do or live by guidelines. I completely understand that. I know many people just like that. If that describes you, then don't move into an HOA neighborhood. It's as simple as that.
On the flip side, I hear stories where other neighborhoods have HOA boards that enjoy the power it gives them and make things difficult for stupid reasons. That's not us. In fact we are the suckers that volunteer for this thankless job and get no benefits what so ever. We pay our dues just like everyone else.

It sounds like he’s in direct violation of doing something trashy that made his house “cool” but decreases his or his neighbor’s value. I would guess some addition, but you said inside so I have no idea. Build some sex dungeon for you and your honey? Mess it up to where you took away a bedroom or something? Waiting to hear epic story when this is settled in May 2021

Not saying this is what is going on here, but I had a friend that put an offer in on a house. The house had a bonus room(attic space above garage) that was added five years after it was built. The room had a secondary entrance via a set of stairs on the back side of the house. HOA said the neighborhood was single family dwelling. HOA claimed the bonus room was an apartment and not allowed. They wanted to hold up the sale until the stairs were removed. He wanted the house because of the apartment. He passed on the house. Don't know if the stairs got ripped out or not.

One of my biggest pet peeves is when someone says “I have a great story for you!” then doesn’t say anything.
OP, as right as you may feel, maybe you are not. Let the lawyers of the OT decide before you go looking for attorneys all over town. It’s not like you telling the story of what happened will come into play in small claims courts or whatever court it would go to
