I have defended a many of BUI's. A lot of not guiltys from trials over the years. The battery seated examination which are the SFST for boating cases is laughable at best.

Best advice I can give:
-Don't drink to a point you are intoxicated AND operate a boat OR have a DD on the boat.
-The marine police do not need probable cause to stop or board your vessel.
-Do not admit to consuming any alcohol.
-Do not volunteer or perform the field sobriety tests.

(Depends what state you are in as to whether you should submit a breath sample in the field or at the station if arrested.)

I’ve started a number of threads regarding entrapment by cops. Got another from my friend that recently got a dwi and has a blower in his car. He was at a restaurant last night that has a pretty good size bar area and is known for being a popular drinking place. Friend had dinner and obviously zero to drink otherwise his car wouldn’t start. Dickhead cop pulled him over about 200 yards from the restaurant because of “no signal”. Once the cop saw the device in the car, he gave him a warning.

Those aren’t cops, that’s Florida Fish and Wildlife, I was told those guys can be complete dicks…

Game wardens are universally known to be the biggest dicks in law enforcement. They know their “power” and abuse it.

She was probably a biologist who they made an agent, the did that about 20 years ago.

Happens to a guy by our camp, local agent, Stephanie, who was a biologist watched this guy climb down from his dear stand, take off his orange, and took a shite. She approached him mid shite and wrote him a ticket for no hunters orange.

She was a total count about it…

I don't completely disagree, but it's the fact that the cop used BS "evidence" in his report to justify probably cause. The stuff about pulling out too many life jackets, the zipper, the extenguisher, and the "bellhorn" are all rediculous and should in no way should that be enough reason to incarcerate someone for 8 hours

Here in Az my neighbor was out on his Seadoo as the sun was going down. Plenty of light to see at the time, he headed to the ramp. There were about 10 boats / Seadoo's ahead of him. His turn to roll in and the po po pulled him over. Even though it was still light the official time was 5 minutes past sunset. And his doo's didn't have lights on them. Blew .08 and off to jail.

If you refuse, they still can say they smelled it or whatever and then you would get arrested anyway.

Also, from what i understand a refusal just gets a warrant and the judge signs it and emails back and they get a blood draw

So either way, they pretty much can put you in jail if they want to

Friend of mine got one.

He was over the limit but not hammered.

They gave him a field test on a moving boat in a smaller creek with a fair amount of traffic.

How you gonna pass that stone cold sober.

Same way I got mine, but I was in a boat. Had front red/green on, but didnt put anchor light. Still broad daylight. I crossed the lake and it was quite chilly. Only had a light shirt. Prick said I was slurring. Well yeah!! My frickin cheeks were frozen.

Had a close call about 20 years ago at Crab Island. A girl had cut open her ankle doing something stupid during a beer funnel session. I took her to shore on a wave runner. Her friend was on one next to us and got a BUI. Didn’t check me. Not sure how that would’ve turned out.
