you do understand thats exactly how you get a DWI dont you
yes its legal and legit to arrest you in your own yard if you are sitting in your car while drunk in possession of the car keys, even if they are in your pocket.

You'd have to be a dumbass to get caught drinking a beer in your car in a driveway. Throw a koozie on it and refrain from tossing empties out the window and you'll be all right.

If a state trooper didn't give me a ticket a few years ago driving in the canefields by the house one drink into a second bottle of bourbon, I would hope this guy could talk his way out of a driveway ticket.
