This is probably one of those deals where the homeowner is not criminally charged but will lose almost everything in the wrongful death lawsuit.

If someone was trying to gain entry into my home and then I find them in my shop/garage, yes, I am going to confront them.

This goes back to the backbone/pussy thing from earlier.

You have to be sure your eyes have adjusted to the dark before going out. The other party has been out in the dark and so his vision will have already adjusted.

But it is sad that a 21 year old lost his life. Sadder still that the reason is his own foolish behavior and bad (impaired as well) choices.

mine happened at Chuck's, we had a TGIF at the frat house with a sorority that spilled over to Chuck's, I had to piss and felt like I might have to puke, tiny bathroom was full so I went outside, middle of nowhere, right? unbeknownst to me the owner(Chuck?) lived in a trailer immediately behind the bar, it was literally less than twenty feet from the back wall(must have had the utilities tied in with the bar,) anyway, I was pretty trashed, taking a whiz, contemplating barfing and I hear the dreaded sound of a revolver being cocked, I looked up and it was 2" from my nose, guys asked wtf I was doing out there and I told him, he gave me a good arse chewing and told me never to come back behind the building again, that's where he lived, I yes sirred and apologized profusely, oddly enough that sobered me up, I rallied and went back in a resumed partying

The homeowner doesn’t know that (technically, we don’t even know that right now). The law is based on the reasonable perception of the homeowner at the time of the action. Someone trying to gain entry into your home at 1:00 in the morning is going to always be reasonably perceived as threatening.

I saw an article about a woman who called the cops on a black man because he went through their back yard and towards where her child was playing. The boyfriend or husband was at work. Of course some think she did the rt thing others think it’s racists.

I think if a strange man is on your property approaching your child, you may have a different feeling.

A couple of points:

1. Homeowner should not have gone outside, call police then wait inside. 1A if he attempts to gain entry - shoot.

2. In LA you do not have to wait for them to actually break in.

3. Never fire a warning shot. PERIOD.

4. last year a neighbor of mine had a drunk/drugged 22 ish year old guy trying to get in his front door at 2 am.. THey called police substation is 2.1 miles away - 42 minutes until they arrived.

5. Every state needs a law that prevents trespassers from suing.
