you act as if he were simply "lying on the ground" NOT resisting arrest. You also apparently missed the officers attempting to use non lethal force: tackling him to the ground and using the taser... None of which worked... SOOO next....

No. Excited utterances are considered more reliable than regular hearsay. "He's going for the gun" would be admissible if the guy dropped dead tomorrow and couldn't appear at trial.

He didn't just blurt it out so the other cop could kill the guy and get away with it. He said it because that's what he believed, and him saying it tends to prove it was true.

A very distinct motion? What the hell is that. You cannot, at any point, see his arm, hand, or pocket. Do you agree with that? Everything else is an assumption at that point. Does it vindicate the cops using deadly force? Sure. Is it clear he is reaching for a gun in an attempt to kill the officers? That is one helluva stretch.

So now it's his shoulder. BTW, both shoulders are moving, but the left hand is not going for the left pocket. Point being is that a shoulder movement does not mean he was CLEARLY, going for his right pocket. He simply could have been struggling. Justified still since they felt or saw a gun in his pocket. Comments about him CLEARLY going for the gun to shoot the officers while he was basically being held down by two officers with guns ARE just as ridiculous as comments that the cops were out looking to kill someone

From the arrest record it was clear this young man was finally ready to turn the corner and become a model citizen and father to his children. Tragic he was murdered by racist bigots. This has to stop.
