I’ll bite.

1. Public figures and government officials have to meet a higher burden to collect damages for defamation. A public figure has to prove that the defendant made the false statement despite knowing it was false, or that the defendant acted with “reckless disregard” for the truth.

2. Defamation requires the plaintiff to show that the false statements led to damages.

So in your scenario, someone “discussing about 9/11” as a generalization would probably not be defamatory unless the government official being harassed can prove:
1. That you knowingly made a false statement about that government official.
2. That your post led to their harassment.

So if you say “the government is lying about 9/11” and some nut job on the forum goes off and burns down the former FAA administrator’s house, that FAA administrator is going to have a really hard time proving you defamed him. You aren’t knowingly (hopefully) lying in a statement of fact. You didn’t even make the statement about the FAA administrator in particular, and it’s going to be hard to show that your statement led to the damages (his house burning down).

If you say “the FAA administrator at the time personally intervened to allow the terrorists to board the planes,” despite knowing the statement to be false, and some nut job from the forum burns his house down.. then the former FAA administrator very well might have a defamation claim against you. The hardest part would be proving that your false statement led to the damage (his house burning down).. which is why people with larger platforms/followings are more likely to be sued for defamation.

If you’re a pundit on a nationally-televised news program and you say “the FAA administrator at the time personally intervened to allow the terrorists to board the planes,” despite knowing that statement to be false, you’re much more likely to be sued for defamation and the damages are likely greater since a larger audience heard your false statement (meaning there was more damage to the victim’s reputation).

ahh, i overlooked that context.

i’m just glad we can all admit that these things are being taught in certain classrooms. likely not widespread, but enough evidence to safely say it isn’t far right wing conspiracy theory.

Jones definitely didn't help himself. He's not getting charged with a crime, its a lawsuit.

The entirety of opinion media is a travesty. Its always been, but was once confined to two pages of the newspaper. Now its mainstream and the primary source of information for most people.

The Jones case has become an amazing flashpoint for faux intellectuals and crusaders of "Justice".

Yes he is an a-hole, and yes he is ETHICALLY wrong, but he ought to have the freedom of speech to say it’s a hoax.

This ruling is bullshite and harms freedom of speech.

Are there any limitations in your mind? Should I have the freedom of speech to continuously tell your employers or community you are sexual predator if I know it to be false?
