So, first freedom of speech isn’t freedom from consequence. Y’all should know this by now.
Second, they met the legal standard of defamation. I’ll repost what I posted earlier. It’s about as clear cut of a defamation suit as it gets.
He met the standard of being sued for defamation:
quote:
To prove prima facie defamation, a plaintiff must show four things: 1) a false statement purporting to be fact;
As he’s now openly admitted, Sandy Hook was 100% real. It was not a hoax with actors. Real people lost real children. His continued statements that it was a hoax was false.
quote:
2) publication or communication of that statement to a third person;
He utilized InfoWars to communicate this lie to a large group of “third person” individuals.
quote:
3) fault amounting to at least negligence; and
Again, as he admitted in court, he knew he was perpetuating a harmful lie and refused to recant. He knew people were trying to harm these parents based on his lie.
quote:
4) damages, or some harm caused to the reputation of the person or entity who is the subject of the statement.
As a result of his perpetuation of the lie, his InfoWars followers and at least one fellow employee made death threats, shot at, and endlessly harassed these parents.

HEAR HEAR!
(and no, NONE of these ignorant Zombies will answer the bell on "Defamation" specifics.)

They are pretty safe assumptions though.

Now do Maxine Waters, SEVERAL Democrats who openly incited violence.
THANKS.

As I’ve said before, you’re welcome to do so in your defamation suit. Feel free to lay it out here.

No one ever accused that guy of being bright or consistent.

Trump insinuated the election was rigged. There is as much proof of that as there is sandy hook was a false flag.
His followers harassed government officials in the White House.
I guess trump should be charged for defamation and those officials should sue him.
“The election” can’t file a lawsuit, and “insinuations” are not necessarily statements of fact.
If Trump Tweeted “the FEC chair colluded with Democrats to allow mail-in voting, in an effort to steal the election!” AND Trump knew that statement was false (since the FEC Chair is a public official) there’s a very good chance Trump could be sued for defamation.
The major differences between your examples and the Alex Jones case are:
1. Alex Jones made his statements about a specific group of people - the victims of the Sandy Hook shooting and their families.
2. Those people are private individuals, not public figures, so they don’t even have to show that Jones knowingly made false statements. They just have to show that he acted negligently - e.g. he didn’t reasonably attempt to find out whether the statement was true before making it. The fact that Jones is now admitting he knew it was false is just lagniappe.* Public figures/officials have a higher standard to prove defamation because they choose to be in the public eye.
*Its really all lagniappe because Jones didn’t even try to defend himself in the lawsuits, he lost by default because he failed to comply with court orders requiring him to turn over evidence in discovery.

Should have been criminally charged. She did incite violence.

Of course it is. The media opinion creates a consensus, and the obedient Zombies react exactly as they've been mind-controlled / trained (as seen HERE on this thread below):

Yes. And I don’t think it’s very subjective at all given what’s been presented. Sandy Hook as a conspiracy theory wasn’t widely pushed by any other major outlet or talking head. Jones went all in and knew his followers (and coworker) were engaging in harassment based on his lie.

And he still has that freedom.
But as any old dumb redneck in a bar can tell you, freedom of speech is not freedom from consequences.
Alex Jones knows full well the power he has to provoke action by the loonier fringes of his audience.

Yes, that is what is implied/inferred according to BluegrassBelle's *cough* "case analysis".
