Honestly it would have been better for CNN to just NOT say ‘the shooter yelled something but we don’t know’.
They obviously know what he likely’ said so that’s just bad reporting.

This law sure has a lot of caveats.
One caveat being that it takes longer to identify the suspect with less witnesses and video.
