Not only did he stop a theft, he probably kept someone from getting killed with that gun. FIRE HIS arse!!!!!!!!!!

Wow. I understand why companies fire folks over going after shoplifters that take shite like electronics and clothes. I don't agree with it but I get it.

However someone stealing guns? GTFO Academy. Especially if he was threatening to shoot someone. A man was fired for preventing a felon from stealing a gun, probably saving an untold number of lives.

This is how you know we are overlawyered as a country.

It depends on how negligent academy was in securing the gun. If grossly negligent, reckless or wanton, then there could be liabilty.

I don't care what store policy is, we're talking a stolen firearm with ammunition. Your gut instinct is to prevent a person like that from escaping with deadly weapons. That he did it knowing it was against store policy makes him all the more worthy of praise for doing the right thing and potentially protecting whoever could be on the receiving end of that gun in the hands of a criminal once he's out the door.

Sounds like Academy wanted to let the guy just walk out with the damn thing. Seems pretty negligent to me if anyone could just ask to see a gun and book it out of the store and use it.

Sure. They have a policy of giving customers control of guns and a policy of not stopping shoplifters. Was the ammunition the perp had also shoplifted from Academy? If so, you have some policies, that working in concert, could be found to be recklessness or gross negligence on Academy's part.

I'm not saying they would definitely have liability, it just isn't a laughable assertion. It is a real possibility.

If company policy is to allow anyone (including people legally not allowed to own/possess firearms) to just walk out of their store with a gun I would think that could potentially be used against them in a negligence suit.

You seriously think a lawyer couldn't convince a jury that their policy boils down to arming criminals? Did you even think of the children?

Would? not sure. But could? Absolutely. If that guy went out and murdered, or God forbid mass murdered, the first question the victim's attorney would ask would be how he obtained the gun.

He would then look for deep pockets (Academy), and through discovery, absolutely tear down their store policies. He would sue them for allowing people to handle the gun over the counter, which creates an inviting environment for theft. He would then absolutely kill them on their policy of instructing their employees to allow gun thieves to escape with unloaded guns, knowing that they could be later used to commit felonies and murder. And before the right jury, most being borderline retards, he would be set for a huge pay day.

Is it all ridiculous? Of course. But I guarantee you that there is a very good chance that in a civil lawsuit, Academy could easily be found partially liable for a murder resulting from that stolen gun.

This is a darned recent policy, then.

Literally just over a year ago in a prosecution clinic I did, I was prepping my Academy manager-witness for an upcoming misdemeanor theft trial. The manager, of course, approached the defendant as he was leaving the store after allegedly stuffing some gun ammo in his jacket pocket and attempting to leave without paying.

No public outcry or firing then. Manager was black, defendant was white FWIW.

While that might be an argument in Academy's favor, there is no gaurantee it is a winning one.

No for simple theft. Yes if they knowingly did nothing and let the theft occur knowing a threat was made.

Trigger locks probably arent difficult to remove once you have the gun at home and access to tools. They just prevent someone from firing the gun in the store itself.

I worked at Academy in college. Guy walked in with some old raggedy shoes, goes to shoe department and tries on some brand new ones. Takes off running for the door, so I chased after him to tackle him. Manager stops me as he hits the parking lot and says we can’t touch them once they get outside. Apparently the thief knew that, too, because he started walking in the lot with his hands in his pockets like nothing happened and looking back at us I was pissed. That policy is bullshite.
