"Sprayers can't allow dangerous pollutants, however small, to migrate onto their neighbors' land," said Boulder attorney Randy Weiner, who argued that wafting pesticides are like a physical trespass.

how is this any different than a man facing penalties for discharging a firearm and accidentally injuring another human?

Seriously? I had a guy at a theatre last week in Houston tell me that bringing in a knife was the same thing as bringing in a revolver.

At that point in time I thought there was probably only 1 person as dumb as he was in this world....now I know that there are at least 2.

Biggest issue is that the organic farm wont be able to sell any products certified organic for three years from application of the prohibited substance

You do realize that the 'organic' label does not mean the crop or product is 100% pesticide/herbicide/fungicide/miticide/nematicide free, yes?

The FDA sets certain accepted levels.

I always say that if 'organic' people want to go back to 1920s farming techniques and the dust bowl, I'm all for watching them starve to death while I eat gluttonously.

Lesson to be learned here boys and girls, don't piece your farm out to hippies, they stink and cause trouble

The next time there is one of those threads asking for advice that your pawpaw used to give, I am leading with this one!
Also, the old man could have solved his problem a lot easier

Two days?! He's lucky to have gotten off so easily.

What he did threatened lives.

You're asking for the difference between accidentally shooting someone with a gun and letting pesticides waft onto your neighbors organic farm?

both are accidents
neither killed someone
both result in minor penalties
both could have been avoided with proper use and responsible practice

what if his neighbor had a severe allergic reaction.. went into anaphylactic shock and died?

or do you simply not respect the neighbors right to his own property? how liberal of you

Considering your property is bombarded by air pollutants on a daily basis, I think the judge was a bit harsh with the "however small" part. Should be a risk based fine, IMHO. Like accidently getting you lawn mower NOx and CO all over my front yard. Or, you breathing in my general vicinity (according to the EPA, CO2 is an air pollutant). No risk = no fine. I have no clue what the pesticide was...but "however small" is stupid.
