It depends on which shot was the fatal shot. He could have been shot multiple times yet still been physically able to move with his final movements placing him partially inside his SUV in an attempt to try to get his gun.

It depends on which bullets hit him where first. The heart & lung shots could have been the final 2 shots for all we know.

And for the record, the attorney for the Smiths is with a well-respected law firm that has been in NOLA for years. He's not some fly by night attorney like O'Neal's whose law license was suspended.
