Not really, if the attorney can prove that Smith was drunk and out of control and was grabbing for his gun Hayes could walk. If Hayes was the aggressor in the second collision it will be harder to convince that he was just wanting to defend himself and wasn't looking for trouble.

It's hard to say because we don't have any video of that unfortunately, which would tell us a hell of a lot. I'm surprised no one at least got some of the incident on video. People are always quick to pull out the phones to record everything they see.

Tell me what those grainy specs are in the video with 100% certainty.

Until you can. you're doing nothing but speculating. There's a reason Scott Walker says it "appears to show" instead of it "shows."

And what does this have to do with the Hit and Run?

Defense attorney could get to that without the Hit and Run.

The H&R is meaningless. The only thing that matters is from the time Hayes hits Smith until the shooting.

No, it's not. My argument here is that if there was contact, it was basically impossible to see in this particular instance. You saying it 100% happened is you speculating. That's not allowed I'm told.
