Heath Ledger OD'd and died in January 2008. The Dark Knight Rises was released in July 2012 - 4 1/2 years later. This myth that the Joker was going to be a major part of the third film needs to die. The only person who has ever said that Joker was going to be a major force in the third film was David S. Goyer. In an earlier form of The Dark Knight, the Joker was captured and put on trial for his crimes. Harvey Dent became Two Face at said trial and the third film would have featured Two Face as the main antagonist. When Goyer presented the Nolan brothers with the treatment for The Dark Knight and its sequel, they took both treatments and combined them into what became the plot of The Dark Knight. Nolan did not want the film to end on a cliff hanger and wanted Dent's arc to be the backbone of the film.
