Unelected judges, a majority confirmed and created via senatorial majorities that only represented a minority of the country, put forward in part by presidents that lost the popular vote, to force changes a majority disagree with and then drilled down in states that are often hyper-gerrymandered and not representative of the majority will of the populace they govern(and why many red states are backing off allowing abortion votes to go to the people, Texas doesn't want to be the next Montana and see their unsupported bans go to the actual people). Constitutionality ultimately comes down to the political whims of the judges seated, it's an often subjective process which is why the almost guaranteed predictor of any ruling is political position on the spectrum. So your problem is how our government is formed? "Unelected judges" also confirmed Roe v. Wade in the 70's.
