They intentionally pick those to throw people off. Remember the "Are you investigating Jimmy?" comment by Kim that so many tried to claim showed Howard was going after them? It was an offhand comment she made with the DA that had nothing to do with Howard.

I cut cable so I’m rewatching this ahead of watching Ep04 tomorrow. On rewatch I found it interesting that Kim is keeping herself in the game even in the face of so many opportunities to waffle and take her concerns to Jimmy later. I am starting to believe that she is Jimmy’s link to the disappearer and that they had the longest term plan in TV history. I pray to God that this is true.
