That's why I said ultimate fate. Sawyer pretty much had the same exact conversation with Kate originally on the island and in the end killed Anthony Cooper.
The cop/criminal aspect of Sawyer's life is inconsequential when compared to Sawyers ultimate fate of being a vengeful murderer who ends up alone.
Currently, both Sawyer and Kate's "flash-sideways" fate hang in the balance dependant on whether or not they truly commit to the MIB on the island (at least from the audience's point of view).

I think this has been aluded to already in a very subtle way:
The MIB was a slave to Jacob. His "essence" or "will" was trapped on the island (in the cabin) and he was forced by Jacob to protect it by being the "judge and jury." From the beginning the MIB was looking for a way to be free from the cabin. When he was freed ("How" I think will be alluded to in the future), he convinced Locke to leave the island and die and the rest is history.

So I think the MIB NOT going over there when they are vulnerable says ALOT more about what going on than the MIB sending Sawyer over there.

i like your thinking...
when we first see MIB last year, maybe he and jacob are alone at that time on the island... the last people were killed off because they were judged by the smoke/mib. The black rock comes and now MIB must revert back to his smokey form in order to obey Jacob and judge the next set of people. MIB hates having to do this and the only way he can get away from "having" to do it is if Jacob dies. Now that Jacob is dead, he can still go black smoke moan all over their asses but only because he wants to.

doesn't seem likely to me considering their personalities are completely different.
