Clint Eastwood kills Scorpio after saying that line the second time. The first time with the black bank robber he was out of bullets and didn't kill him.
And although I'm not sure with 1 or 2, but in Die Hard 3 McClane says it before shooting the electric wire and killing everyone in the helicopter.
