Stewart was much higher on the track than the car in front of him which makes me think it was also very unlikely he was shielded from seeing him

I don't see how someone can go out and race the next day after something like that.

Height on the track has nothing to do with vision angles. A shielded line of vision can happen anywhere, high or low.

From watching the video on ESPN, the kid was at fault. You would have to be out of control to walk on a dirt track during a race.

Most of my arguments are based on what I can actually see and deduce from the video.
If I had to guess, Tony wanted to scare him but wasn't prepared for the kid running up and down the track after him. He was going faster than he should and expected him to move if he got too close. Let's not forget that Ward was being just as irrational as Tony was allegedly being. He was being extremely reckless.

Tony employs team sweep. Pays enough to have some dirt track in NY renamed Kevin Ward Track and pays the family $1 million. Case closed. The family ends up satisfied and Tony goes on with his life.

Oh, ok. Explain to me how vision works since Im not a human with eyes.
A better post would have been that the car in front of him may have just moved down to the bottom of the track, and tony was looking at the wreck as he drove by instead of the car in front of him or the guy.

Looks pretty open and shut to me. Guy (stupidly) walks in front of car thinking tony will slam on his brakes, Tony tries to avoid him and clips him. Nothing in that video shows me that tony did it purposefully
