Holy shite there is no way you can say that with absolute certainty from that camera angle for the second he was in the shot before he hits Ward.

It's blurry, but it doesn't look like Tony's car is much higher than the 45. And it certainly doesn't look like his car is at any different angle than the 45's... This is the only frame that we have prior to him hitting Ward. It's after this that he goes toward the wall.

It is higher. Ward didn't move lower and Tony came right at him. There was space between the 45 car and Ward Jr as well.
Why is it that the 45 car sees him and comes around the corner slow (like every other car) but Tony didn't?
It's obviously they can see him and it's obvious who he was melting down at.

I'm not saying he hit him on purpose or anything like that, but he had to have seen him.

Stewart was directly behind 45, and his view was obscured. 45 dropped lower, Stewart didn't see the guy until too late. This is a common reason for accidents when a vehicle in front reacts and the trailing vehicle has less time to correct.
The first car in the video after Ward Jr. exited the car is higher than the others.

The problem with some of the people posting here is that they are dealing in absolutes. It's either all Tony or all Ward's fault. Assuming that Tony accelerated right before impact to sling dirt on this dude, I think he would catch a percentage of fault, but the dude getting out of his car and walking on the track to give TS the bird definitely gets assigned a higher percentage IMO.

I already addressed this. He just walked out front. They just saw him.
By the time he walks into the middle everybody has seen he has lost his mind.
You're just proving my point because the guy who drove high STILL didn't hit him. It isn't some freak accident. Tony probably wanted to nudge him or scare him because he came out of his car hot.
Then shite went sideways.
