Let's assume for the sake of this thread, that each party involved can be assigned a percentage of fault for the accident.
Ward 75% - Tony 25% (?). I don't think the track will catch much liability, even though there are no spotters there. I think there will be spotters at dirt tracks in the future because of this incident though.

the only reason people are saying that he didn't hit him on purpose is because he is a hugely popular nascar driver. had it been any other driver on the track that did this people would assume that it was intentional.

I just watched that video for the first time and wow. Just wow. Tony Stewart is in a world of shite. Prayers sent to that young man and his family. I really can't believe what I just saw.

His car moves up the path.
He is known to be a hot head. This isn't the first time for him to be in a skirmish like this.
You act like drivers never bump cars or other hostile drivers ever. He just ended up killing the guy.
Keep on defending him. I bet if he admitted to it (he would never) you would still find a way to.

It isn't by some chance that occurred. They were running much slower. Ward Jr was specifically going at Tony Stewart.
So why did he hit the gas?

Tony Stewart is my favorite driver. I don't know what can be and can't be proved. But wow from what these old eyes just saw that did not look good at all. Very shocked.

This video it shows Ward walk out. The last car (blue) avoids him. That's when Tony Stewart comes into view.
BEFORE Tony hits him, Ward tries to move. Tony's car moves upward toward Ward, BEFORE he makes contact. After making contact it skids using the kids body and continues upward before balancing out.

From the 8 second mark to the 15 second. It is VERY clear before Tony hits him his car diverts upward. It is very clear Ward Jr sees it divert upward and attempts to get out of the way putting his hand down.
They're in a yellow and his car suddenly accelerates. The video makes this obvious as well. Why did he?
