Truth of the matter is this crap goes on at a dirt track almost every saturday night, this is just the first time somebody has gotten killed while doing it. Had it been anybody other than Tony Stewart who hit the guy it wouldn't have been major news.

I don't think Stewart's position on the track will be damaging to him. The guy who got hit looked like he'd have done anything to get as close as he could to Stewart's car.
I don't know what some people are looking at but he came pretty close to being hit a couple times before Stewart got him.
I really think what happened can be easily explained away by a lawyer as a complete accident. So many things could have gone wrong in that situation, and they did.
I have no idea if Stewart tried to scare him or not, wouldn't put it past him.

If everyone was forced to guess, not as a jury but just as a pick what happened, would most guess:
A. He did everything he could to avoid him and avoiding at all cost was his only intentions
B. He was trying to buzz the tower and screwed up
I say B

I think that's a very fair and level headed opinion. I have no beef with that. But some other less logical posters are already reaching for an ultimate conclusion based on very little evidence. I just don't see the point of making up ones mind so soon. There undoubtedly will be more to come of this. Some people are just in such a hurry to see things as black and white when there is right now a lot of gray.

C. He was dealing with something in the car such as removing a tear off, adjusting breaks, checking out gauges, or a whole host of other things, and at the last second tried to avoid him when he saw him.

It would be major news, but people wouldn't assume guilt or negligence with any other driver because it's doubtful there would be a history of bad and dangerous behavior with another driver.

Nothing in that video shows him doimg thzt yhough. You are just sticking with you want to see because if you admit that youre wrong you will feel stupid that you wasted your day arguing the wrong side.
People are acting like this dirt throw is a super common aoccurancd. Tony is awesome to think of that new trick in the split second thzt he saw the idiot jump from front of the 45 car. Even better the guy is walkig towards his car and hes walking right into tonys master plan...
Except they are in the groove where the track is slick...the dirt thats gonna be thrown would be the cushion which they werent near.
But tony prob didnt think of that when he thought of the new dirt where there is none trick

With his history of aggression towards other drivers, plus the feuding these two were doing during this race, I would say that was exactly what he was trying to do.
Probably not something they can convict him on anything though, unless there is some other evidence.
