Why don't you read what the witnesses said from the report.

Who were close and live and could tell the difference of which cars are throttling up.

You're being obtuse. and most people on here are ignoring the statements from other drivers.

Everyone just wants to watch some stupid gif in silence and act like a freakin' expert.

You weren't there...you can't judge the distance, sound, what happened before.

The answer to that is based on intent. Doubt that can be proven unless video evidence shows Stewart was trying to get close to him to scare him.

Can't lose sight of the fact that the victim in this incident is also to blame for his death.

Who has more blame? I don't know.

And to a good extent, even the people there won't be reliable. Video often is if there's a more complete and extensive angle.

Legally, it would be hard to cast blame on Stewart unless additional video evidence comes out.

The kid was an idiot for getting out of his car into oncoming cars, but I find it hard to believe a world-class driver like Stewart could not have acted more responsibly in avoiding the kid. They were both acting like hotheaded assholes and now one of them is dead.

Who can also be seen as an emotional friend of the deceased who was asked to make a comment moments after the incident.

In the end, he's just another eyewitness. Him being a driver doesn't necessarily give him insight into Tony's intentions.

That's complete speculation, nothing that anyone would take seriously in court. Is there any recorded statement of Stewart saying anything that would support that assertion?

Look, I'm not a court of law. I am making a guess on what happened and these are the facts I have to go by:

Stewart is known as the biggest a-hole and most hotheaded driver in NASCAR

A video that doesn't show much

One driver who is a friend of Ward( I don't know this for sure just what some on this board are saying) saying TS was trying to scare him

Based on this if I had to guess, and was forced to guess one way or the other I would say TS was trying to scare him. And I don't see how others don't say the same. Not saying in a court of law, just saying as someone on a message board who would be forced to pick one way or the other

Fair enough. And I have no problem with that. We can disagree and argue, but at least you realize you're making a guess, maybe even an educated one.

My problem has been with the people coming in ready to convict TS and throw him in jail because someone died... all based on this video, which if anything, implicates Ward more than anyone.
