They are now. They've been avoiding it. Nothing comes easy with how much these two sides distrust each other, and the players clearly have leverage or MLB would not be afraid of a lawsuit.

Manfried is in his position through the new CBA negotiations. Manfried is the owners ace in the hole when it comes to negotiations. He is a damn good lawyer and was the owners go to guy for the CBA negotiations since the late 80s. He's going to destroy Tony Clark, then ride off into the sunset.

Think about what Manfried has done in the last few days.
1) Says there might not be a season
2) delayed international signings until 1/2021
The reason why those two things are important is what Tony Clark agreed to in March.
The owners gave MLBPA $170 Million in advances on player's salaries. If the season is less than 75 games some players will have already received more than what their prorated salary would be. The fewer games the more players that would be in this situation.
But according to the March agreement those players don't have to pay the money back to the owners, MLBPA agreed to cover the difference.
MLBPA didn't anticipate the amount being large and was going to use revenue from the tax on teams going over their international signing budgets. Now if there is no season the owners are owed $170 million and there's no revenue from international signing this year.

Both sides are not winning over new fans here. Cooler heads should have had MLB first in line to play. Understand this season was a wash and no one was making money. Remove barriers so casual fans could make a few games. Build a lot of good will for the upcoming strike.

The best thing that has happened for the players, and surprised it took Clark this long to let it happen, is Scherzer, Harper, etc speaking out...
The best thing for the owners are the players not budging so the scabs can come in eventually and fracture the union.
The worst thing for causual fan is both of the above
The best thing for the fan is you are seeing how labor negotiations really work and it is not easy.
I think the players are wrong on this in some fashion, but Snell was the catalyst for that opinion. The owners are wrong in setting artificial limits, but it is their game and business, so they can run it how they see fit.
The best thing for the owners are the players not budging so the scabs can come in eventually and fracture the union.

I don't disagree with anything you said.
I hope both sides sling all the mud they have, even scratch the season if necessary, and come to an agreement they can live with for a couple decades.
I only ask one caveat. I want all involved with the sign stealing to be able to speak freely with no recourse.
One thing is certain to me. Mike Fiers is not the end all be all voice on the evolution of this. The truth will harm the game insignificantly compared to the coming strike.

The American sports consumer has more options than the mid 90s when the last strike took place. They need to be careful here. The population is moving south, and MLBs footprint is not large in that area. What happens during the next few years will have lasting effects on the brand.
