Yes, they would, but the public won't. No one can honestly believe this was unknown to Urban. The only people that truly need definitive proof would be the US Department of Education if they wanted to sanction OSU. FWIW, I don't think this blows up to that level.

That was actually going to be my next question. I think they rescinded a lot of the lower thresholds that enabled schools to go after people themselves. Since these incidents occurred before that happened though, I wonder if the old stuff still applies.

For all intents and purposes, it's the universities interpretation of their obligations under Title IX. All public universities have a very similar policy. You can assume it's as strict as it needs to be and that's it. Few places are going to enact more stringent policies than necessary because of the headache.

BTW, by 2015 Urban knew of this guy's past. Is it really a stretch that his wife wouldn't tell him about new transgressions? This wasn't their first rodeo.
Unrelated to your post, but my conclusion is this is all about court of public opinion for Urban. It's a PR disaster to keep Meyer beyond this week. Recruiters will eat that shite up this offseason. Media will talk about it incessantly. Toss in the #metoo crowd and that makes a mighty large shitburger to eat for the sake of winning some football games.

One would assume the policies in place at the time of the 2015 incident would prevail. The one major issue that I looked into was a change in university policy on 9/1/15. Prior to that date, domestic violence wasn't even mentioned in the policy. It was strictly a sexual harassment policy. However, the incident seems to have occurred in October 2015, so the newer policy with domestic violence would have been in play.
This all happened right after OSU made pretty significant overhauls to their Title IX policies. Urban claiming he was unaware of the obligations would be a poor decision if he goes that route.
