Ronald Gasser, the motorist sentenced to 30 years in prison for fatally shooting former NFL player Joe McKnight during a road rage encounter in Jefferson Parish, will receive a new trial after the Louisiana 5th Circuit Court of Appeal on Wednesday vacated his manslaughter conviction because the jury's 10-2 verdict was not unanimous.

The three-judge panel's decision comes in the wake of the U.S. Supreme Court's April ruling outlawing split-jury verdicts.

After a seven-day trial, the jury voted 10-2 on Jan. 26, 2018, to convict Gasser of the manslaughter, a lesser charge.

The Louisiana Supreme Court this week denied an appeal from Cardell Hayes, the man who is serving a 25-year sentence for shooting and killing former Saints player Will Smith.

Hayes had asked the state’s highest court to reconsider a ruling from the state 4th Circuit Court of Appeal rejecting his request for a new trial or a reduced sentence. But the justices decided, without dissent or comment, to block his request from moving forward.

Dane Ciolino, a law professor at Loyola University, said Hayes’ options now include filing a long-shot appeal to the U.S. Supreme Court on constitutional grounds, or taking a post-conviction appeal back to the district court, which can be a long process.

Luckily for New Orleans he had a shite attorney

Although Barker filed Hayes’ appeal with the state Supreme Court, he wasn’t on the case when the justices rejected his application on Monday.

The Supreme Court placed Barker on “disability inactive” status as a lawyer in January, which means he voluntarily consented to be ineligible to practice law in Louisiana.

Ironic that the highest profile beneficiary of that decision is a white guy who killed a black guy.

I hope they convict Gasser on retrial. He's a psychopath and we're all safer with him off the streets.

The guy who killed Smith should not have been in jail to begin with.

Will was the aggressor

Ciolino is Ronald Gassers attorney, and Ciolino is a beast... so he'll most likely win his appeal.

frick Sean Payton. He injected himself in a trial and used his status to push a jury to convict a black man who shouldn’t even be in jail.

Good. Non-unanimous verdicts in criminal trials should never have been a thing. If the State can't get a unanimous verdict, they didn't carry their burden of proof beyond a reasonable doubt.

Haha. The dude shot Will Smith to death and shot his wife too. Will Smith wasn't found dead near Hayes' car. He was found shot to death in his own car. And the guy riding with Hayes testified that there was no physical altercation between the two. Smith acted like a jackass too for drinking , driving and being too macho, but Hayes is where he belongs. You can't just shoot a person to death over an altercation.

Pretty much the assessment of just about everyone who worked on the case. He's a real nut case. There were things in that case that were not widely reported. He actually stalked McKnight around the West Bank of New Orleans. McKnight tried to shake him by snaking through some residential streets and Gasser was right up his arse.

He won his appeal, he gets a new trial. Although I doubt there will be a trial, expecting a plea deal. Drop his 30 year sentence to 15-20 years.

What's crazy is that they can't retry him on 2nd degree murder chargers because the jury voted 10-2 for manslaughter instead. Since the manslaughter charge wasn't unanimous it was tossed, however double jeopardy still applies.

Who are the scumbag, but stud lawyers in New Orleans?

We have about 6 here, and all have specialties. One is so good, he got himself out of a DWI, where he hit the median, by end of trial, he made the poor cops look corrupt, and they 100% did a great job, and had him dead to water before the trial, but great lawyers know how to get people and themselves off.

it was reported that gasser crossed over a couple lanes of traffic to follow him When McKnight tried to lose him at an exit. Terry pkwy I think. Then the dude tried to claim self defense after he followed McKnight. Nah bro. I would have def voted guilty of murder if I was on that Gasser jury. On the smith case I don’t remember the details as well but I remember agreeing w manslaughter Verdict.

McKnight was headed to Terrytown, Gaser to Harvey.

McKnight instead took the first exit (Gen. De Gaulle) which was to Algiers, Gasser followed. McKnight went down De Gaulle turned on Behrman toward Terrytown, Gasser followed.

McKnight got out of his car and was shot at the light at Holmes and Behrman, in Jefferson Parish. 99.9% of their interaction was in the City of New Orleans. He was shot less than 20 yards from the city line.
