I think we are all confused. But it looks like Biden’s steel tariff’s were done under the trade expansion act which is different authority from what Trump has now used.
Per the discussion of the trade court in striking down of the Trump tariffs, the trade expansion act allows for import charges when there is a finding that “an article is being imported into the United States in such quantities or under such circumstances as to threaten to impair the national security.”
So I assume the Biden steel tariffs were targeted to a specific item to address dumping or some other issue that was undercutting American competitiveness?
With Trump there is no such specific article being addressed here. He is using an emergency declaration to do blanket tariffs.
A major problem with that is the blanket, untalented nature, and emergencies are generally sudden in nature. The emergencies used here have all been slow boils. Congress can act to address a slow developing problem. The trade court decision spends a lot of time on if a trade imbalance supports executive action. At least for the trade court panel, it does not in the manner Trump has sought.

The concept would be redress for years of bad faith actions by certain partners. E.g., BYD subsidies being presently used to price Tesla out of the Chinese market, after stealing Tesla tech and assembly processes there.
I mean tesla agreed to that set up when they voluntarily invested hundreds of billions in china.
Also the US has essentially banned Chinese vehicle imports long before the present batch of tariffs.

People can whine about checks and balances all they want
But the eroding of trust in the judicial system will have massive consequences.
I don’t particularly care on this issue of tariffs but the courts trying to stop deportations while allowing mass migration for four years has completely destroyed my trust in the system.
And you can spare me the “blame congress” speech because I would deport every person in Washington DC to the moon if I could.

This was your question...
This was your response...

Without using Grok, what should be included in a strong trade deal?
I've asked this like 6 times whenever people say trump is making deals and no one ever gives an answer.
This was your response...

Tariffs are legit a legally dubious action the WH has taken, BUT…..
The amount of rulings against the administration that have been overruled by scotus or other higher courts has been quite large.
The tariffs are one thing, but these constant injunctions against federal employee firings or immigration enforcement are a complete farce.
I think scotus has the same view which is why they will rule to strike down nationwide injunctions.
“Judge shopping” needs to go. The groups filing these lawsuits are going to the same judges over and over again to get TROs granted.

I think the better route is to reign in executive orders and force the President to work with Congress to pass legislation

Yes, for tariffs and such.
But things like federal workforce downsizing are executive branch authority that historically have not required congress.

U.S. Court of Appeals for the Federal Circuit grants pause over trade court ruling. Tariffs remain in force.
All this is such a waste of resources, court, money , time, on and on.
Bunch of petty democrat bullshite, hope they enjoy their 19% approval rating.
And the tax payers (us) pay for all of it
