12 is a little low, but an area manager for 2 restaurants shouldn’t fetch more than $80k or so.

Yeah. Something doesn't smell right. He's basically being paid like a silent owner/partner. And he's doing the bookkeeping/admin and hiring. Those are the kind of things offered to a head waitress to throw some extra dollars her way to keep her from looking at better restaurants or legitimate careers.
If he's getting 30% of profits without buying in to the company stock (and all he has to do is backend office work?), I'd say that he negotiated a good deal that has the opportunity to bite him in the arse like it is.
That is how partners are paid (profits).
If he doesn't like it... literally buy 1/3 of the company and then hire that waitress to do what he was doing for $25/hr (it isn't full time hours to KM and do books for 2 restaurants).

I'm honestly surprised that you got any restaurant to agree to giving up 40% of their profit. That said, I'd tell this guy that he needs to get a loan to pay you and that you'll require a commitment in writing moving forward.

There is so much fail in here.
1) No contract - not sure how you are expected to be paid.
2) You are very likely to be an employee, not a contractor, based on what you are doing, no contact, no billing, thus no control of terms, etc.
Restaurant owners are notoriously terrible at running a business from a business hygine point of view. Combine that with your lack of attention to detail, and we end up here.
I would find another job. No way I'm working and not getting paid.

40% of profits honestly seems insane for the work you described. I think I'd be willing to drop that % a bit if he balks at creating a formal contract using the current verbal terms

He's using capital to renovate the restaurants resulting in no net income for them. Which means per your agreement, you won't be getting a check. I don't agree with it but that's your agreement with them.

I was a back of house restaurant manager when I was younger and did the same stuff you outlined for far less. You've been fleecing ol boy and now he wants to be on top lol.

You’re screwed. He’s figured out that he doesn’t have an obligation to pay you because there is no agreement. You’re paying for his renovation work. He probably tells you went everything is completed, that he doesn’t need you anymore.
