As you said, the wiretap was inadmissible in the first trial on the basis of relevance. Defense counsel seems to believe it's more relevant with re: to this particular trial. That's up for the judge to decide. But make no mistake, defense counsel is leaking this to Yahoo to if nothing else, exact a pound of flesh against the coaches who, lets be honest, were very much involved in the "process" of college basketball recruiting (not just Wade), because it seems a bit unfair that his client will spend 9 months in jail for a practice that everyone, coaches, agents, shoe companies, AAU promoters are all happily involved in.
It also circles back to the SDNY US Attorney's office being so attention starved that they are wasting federal resources to essentially investigate minor and largely victimless crimes simply because it gets them major headlines. They're putting a guy in jail for 9 months for a "crime" in which no one was defrauded. The judge recognizes that. It's why the sentences were extremely light.
Public institutions (i.e. colleges) aren't being "fleeced" by bribers. They're happily benefiting from great players attending their schools and generating profits for the athletic depts. But SOLELY because the SDNY always wants to be in the limelight, instead of just prosecuting significant crimes MUCH more harmful to the public at large, we get wastes of time and resources to stop a "wrong" no one is actually concerned about being stopped...including the purported "victims".
At its core, this is a notoriously attention seeking US attorney's office virtue signaling strictly for the sake of publicity

People just don’t understand recruiting here when it comes to basketball. So many people are moving around, there’s no signing day when everybody has to make their choice at once. People move all the time depending on where other players are going. Smart brough guys with him when he signed. There’s all kind of “horse trading” going on with players and coaches it’s not that simple and they could’ve been talking about anything regarding Smart.

The hope is there’s enough plausible deniability that the NCAA can reasonably decide not to investigate, bc they know if they do every single team that dealt with Dawkins will go down. Which is likely the majority of major conference teams.

Was giving him the benefit of the doubt because if extensive meant all the blue bloods included in the investigation would be in hot water too or add to the severity, that’s just laughable.

Because it’s made to look that way. Look at the actual evidence and you’ll see there’s nothing to it. The FBI was in BR because of this last year and left satisfied. I can’t believe people still take headlines seriously.
