If he was responsible for paying Nuss he should be tarred and feathered.

When that email from him next day after firing came out I said “….Who says “lets do a settlement” this early?”

Wonder if this will affect the search

I don’t think the RANT understands the offsetting payment language in the contract…… if BK was offered 30mill and passed on it he’s a fool

He could take less adjust the language and either coach again or go on tv.

thanks to Woodward, he has LSU bent over a barrel and there is not really anything LSU can do

Not really accurate, but whatever.

. It's now being reported Kelly wants the entire amount of the buyout, which I don't understand why that was in question, in the first place.

If I'm owed $54M, and you had to pay me until 2031 for me to get every penny, then so be it.

Would you leave money on the table and take less?

If you'd read any of the other hundreds of threads on this before starting another, you'd understand there are a lot of reasons that BK would take a smaller settlement and be better off for it.

Kelly and LSU signed a contract. I would want what the contract owes me.

Kelly also has a duty to seek emploment to mitigate the buyout.

quote:

Duty to Mitigate. In the event of termination by LSU without cause, the amount of liquidated damages owed by LSU under this Section shall be reduced and extinguished by and to the extent of any compensation Employee earns, receives, or is entitled to receive for football-related employment, whether intercollegiate or professional, including coaching, administration or media, from any third party from the termination date until LSU's obligation pursuant to this Section to Employee terminates or ceases to exist. Employee shall exercise due diligence and good faith in seeking qualifying employment so long as the liquidated damage obligation exists. In the event Employee obtains such other employment, Employee must notify LSU and provide documentation reasonably requested by LSU to determine the amount of compensation received by Employee and the amount of offset due to LSU.

The law is an interesting thing.even the best written contract can be litigated and tied up for years where no one really wins but attorneys. Attorneys really prefer settlement.
Agents are good negotiators but litigation is not what they do.
Kelly's Agent really wants to settle. He nor Kelly have the money to tick off a billionaire or two who can litigate them to bankruptcy

If he wants to coach again it’s in his benefit to take a reduced payout. If he plans not to then make LSU pay all of it.

I'd negotiate a lump sum with no offset and go coach at a smaller school for a few million.

You could do that without a smaller buyout and just get the difference.

And this is why alter accounts will never see this kind of money.

If he can get a smaller lump sum or shorter buyout of equivalent value with no offset, it would be a no-brainer to me.

I'd settle for half ($25-30 mil) NOW and end all ties to LSU. AND I would require LSU to buy my house in BR. :-)

I think the issue is that he probably doesn't want to coach anymore and perhaps didn't get the offers to be a commentator that he expected when he seemed to be open to a negotiated settlement. So the offset language isn't leverage for us like some might expect.

A simply NPV calc lump sum at a reasonable discount rate and I'm gone.

There's a saying about car salesmen - a decent one sells you a car, but a great one will make you feel like you got a good deal while doing it.

I wonder what LSU would settle for if he quit LSU for another job.
Do you think they would settle for a smaller buyout?
