So there we have it. JJ kicked the douche that threw the first punch. Guy isn't seriously hurt. Case closed.

unless the guy the kicked the douche isn't jj and jj is the one that pulled the guy out of the truck.

Which i don't see JJ doing. Dude has never done anything like this at all.

According to him. Yes. I guess it's in that video somewhere.

After watching it -- I see him get kicked, stand up, and walk off. To any lawyers.. how do you prove that someone was knocked unconscious if he wasn't sprawled out on the ground.. I can't imagine a victims word being enough.

Cracked vertabrae could be his tailbone/arse if he got cold cocked and fell straight down.

Loss of consciousness is enough to warrant a 2nd degree charge. Lowery claimed loss of consciousness.

I'm not declaring whether its true or not.

my bad. Still loss of consciousness is subjective and refutable. Not saying it didn't happen of course, but it is far from fact.

Cracked Vertebrae looks more like a stomp injury than a kick in the head injury.

Actually, the type that gets your released from the ER in two hours in more likely due to compression - as in falling on your arse on concrete.

I know there's an extended video, but the main portion is only a few seconds long. Can you be unconscious for only a few seconds?

I've been at a fantasy draft party and just saw this thread. Has TigrLEE jumped yet? I missed the news, too.

If Lowery threw the first punch would he not be the one charged with simple battery? The defender was acting in self defense to the first blow.

I think Miles may have to do this from a PR standpoint FWIW.

Sure, but I don't see any legit way to prove that unless you can test for it in the hospital -- something I have never heard of. You may be able to see that he has a concussion but that does not indicate the loss of consciousness.

According to him, but it surely didn't look like it on the video. That was more clear than telling if he was kicked and by whom.

Yes, he could. I hope that after this stink is finished he will be charged and convicted.

i'd just about guarantee there is a neurological test that can detect head trauma and whether someone shows signs of recently losing consciousness

Yeah, that's what I'm getting at here. If he was unconscious during the video, it's almost impossible to prove because everything happened so fast.
