The 5 for 5 deal didn't come to light until later in the year, right?
Yes, but it was widely speculated for months leading up. Even if their eligibility for this year is unsure, at the very least we'd still be in basically the same position of waiting to see on eligibility rulings.

Per Trilly, King Gibson announcing Sunday or Monday and LSU seems to be the front runner. Just wrapped up his LSU visit

If he wanted to take an aggressive approach to roster building, why didn't he go all in on the 5 in 5 guys?
Multiple reasons.
1. On the whole, the international pro market was likely better than the speculative 5 for 5 market.
2. International pros signing to play college basketball is nothing new. It's been happening for decades. In fact, McMahon's top commitment had he stayed was one. LSU is not the only program trying to roster international pros. Far from it. Arkansas just got a Finish player who played professionally in Serbia last year approved.
3. The 5 for 5 rule wasn't approved until late June which meant it could not be challenged until after that. It would be MORE risky to wait until late June/early to try to sign a significant part of your roster that had less of a history of being approved to play.

Arguable, but sure.

Signing internationals isn't new, signing internationals that were drafted by NBA teams and/or are this old is certainly new. People keep throwing out Illinois and Muurinen as comparable, but none of those guys were 23 - 25 years old when they initially came over like Dessert, Santos and Madar and none of them were drafted by NBA teams like Niang and Madar.

In terms of actually recruiting those guys, sure, although it didnt seem to matter with Dent and Clark. In terms of eligibility, I don't see how it can be more risky when we are sitting here a month away from tip with a third of the team's eligibility up in the air.

A few twitter posters are saying the hearing has ended and that there is no written order issued yet (unclear if that order is coming), these posters are taking that as a sign that the injunction or TRO shall remain in place. Not sure that is an accurate read. If the judge issued a ruling from the bench, it would be public by now. If the Judge took it under advisement, then a written ruling will be coming.

This is correct. No order issued; the TRO is still in place. The judge will likely issue a preliminary injunction, since he issued the TRO. The NCAA will then appeal. Dent's status will depend on the appeal's outcome.
Also, the case Clark is covered under is still before the 3-judge review panel, and nothing has been issued.
There are some Euro press reports that Niang will return to Europe to play and won't pursue legal action in the US if he gets an unfavorable ruling from the NCAA.

Question is how long that process takes

Depends on the jurisdiction. Could be one month, could be 6+ months.

So we’ll deal with this all season, awesome

Update: the hearing will continue oct 20th

The TRO remains in place until then. He should be good for the first exhibition game.

Owen Foxwell, who was McMahon's prize commitment before he was fired is 23. Plus, there have been plenty of "older" players sign to play college sports with no issue. Josh Booty was 24 when he signed to play QB for LSU. Chris Wienke was 25. Age was never an issue...until the NCAA recently decided it was.

Because there is a decades long precedent of international pros being allowed to play college basketball. It has only now become a "problem" for the NCAA because the pros are wanting to play college basketball because they can make more money. The NCAA wants to try to keep up the facade that major conf. basketball is just an "amateur" sport. So now they are haphazardly and selectively trying to reverse course on something they allowed for decades.
The 5 for 5 guys are challenging the applicability of the 5 for 5 rule. They could not challenge the rule until it was actually approved...which was not until late June. Trying to go the international route was the less risky play because college basketball is full of international players. Hell, UT-Martin had 13 of 18 players on its roster last year who were from overseas.

I think that these types of decisions are what is driving all the angst (strong feeling of deep worry, anxiety, or dread, often felt without a specific, clear cause) and anger towards the NCAA and SEC. This includes not being able to define what a professional is. In basketball, is it being drafted by an NBA team, declaring for the draft, signing a professional contract with an NBA team? G-League? What about overseas pros? (Note that playing in an overseas pro league is not currently disqualifying under the current rules put forth by the NCAA)
Then comes the SEC’s new rules. What happens if their rules are at odds with the NCAA rules? Well, the court system, that’s what. Contradictory and unbalanced rules and rulings by the “governing bodies” of college sports leads to where we are today. They could have easily, and still could if they were smart, made rules for going forward without punishing all. But instead, they were lazy and decided not to think things through
