per the regulations, such as they are anyway, an athlete has to be enrolled in school and on campus before any nil funds can be dispersed. sooooo....they are dancing all around the "truth". At THIS point in time, they have not received any nil funds.

I'm willing to bet a lot of the money from ATM is never filed on record with the NCAA as "NIL". It's just bags of cash.
They may have some promises to deliver ongoing NIL deals, but people gotta stop pretending like this is all opened up by NIL. They're also just flat-out playing the bag game at record levels.

Actually it’s quite different. When the USSC passed NIL states also adopted regulation of what would be considered NIL. Save Texas. They refused to adopt it. Alabama is now removing the agreement, and other states will follow. Louisiana and Mississippi will probably last to make the move in the South.

The laws in the state where you sign are going to apply to a signee. State residency (there is no such thing as state citizenship) doesn’t apply here. Matthew falls under the Texas law, which makes it clear that the school can’t have anything to do with setting up NIL deals between students and boosters or others. It also specifically prohibits using NIL for recruiting.
While Texas doesn’t have the restrictions on boosters setting up NIL deals with students that LA does, what A&M is reported to have done is still 100% illegal and clearly breaks the Texas NIL law. That’s why I mentioned it.
Jimbo came out swinging yesterday to try and deflect attention from this. He can’t admit to what they are doing. However, I think it backfired on him, because all it did was get the media and more people talking about it.
I think it’s clear ATM’s signees and their families were coached on what to say. If they let slip what was happening, it wouldn’t be an NCAA violation and slap on the wrist. It would be breaking state law. No one’s going to jail over this, but the booster/business, kid and family, or any coach found to be involved could be rung up with a shitload in fines.
ETA- Since Caleb Douglas’ specific mention of NIL during his commitment was raised in an earlier post, it’s important to note just how much these state laws are starting to diverge. Florida started with a strict NIL law like LA’s. The schools pushed for change and it was amended in December. Now the Florida schools can directly assist their students in setting up NIL deals.
Now, it’s likely that Douglas still did speak out of turn, because NIL deals aren’t supposed to be used for recruiting. However, I can understand why UF would be more lax about NIL than LSU or A&M. They are allowed to speak to their players about it and directly assist them.
The point of this is that the LA law needs to be changed to allow this immediately. Then we all need a federal law to govern NIL to a single standard in the long term.
