A legal fight between Bud's Broiler Holdings, the company that owns the Bud's name and recipes, and Shannon Prince, the franchisee of the City Park Avenue location, puts the restaurant's future in doubt. The franchise agreement required Prince to buy almost all her supplies and ingredients from the Bud's Broiler company. In a lawsuit filed Nov. 21 in Orleans Civil District Court, the company claims Prince bought burger meat from another source and “attempted to duplicate” Bud’s hickory smoke sauce. The Bud’s Broiler company sought a temporary restraining order that would stop Prince from using the Bud’s name and “trade secrets” and operating any business at 500 City Park Ave. that would compete with the New Orleans-based burger chain. According an attorney for Bud’s Broiler, the restraining ordered was granted last Wednesday (Nov. 21). Along with unspecified outstanding fees, Bud’s Broiler also asks that Prince pay a $10,000 early contract termination penalty. The franchise agreement says Prince cannot run a competing business for two years after the termination of the contract.

Hope the owner will just rename it Buddy's Broiler and paint a mural of Buddy D on the exterior wall.

When a franchisee does not want to abide by the contract that was signed when entering an agreement with the Franchisor. Now that the owner learned the business let’s just screw over the company, the agreement and the contract that was signed so the owner can learn how to run a business that was proven. bullshite!

Buds fault is they have been to stagnant to allow the franchisees to have more power than they can control.

This is the typical problem with the franchise system when you are starting or small.

With that said. Anyone have the hickory sauce recipe? What about the chili?

Don't think they can use any version of "broil". Cyborgsaint initially changed to Ben's Broiled Burgers and the judge made him change to Ben's Burgers. I think the other conditions was couldn't use the hickory sauce and couldn't put hot dogs on a hamburger bun. (thought this was america?)

That was the most amusing part of that whole deal.

I'm not taking sides in this, saying what party is right or wrong, but I've been knowing Shannon since we were kids. Went to school with her and lived in the same neighborhood, and she has always had the attitude that rules didn't apply to her.

So this didn't surprise me at all.

I'm just happy she got a Bud's in Baton Rouge. My dad and I will be hitting that location up constantly during baseball season.

In October, Prince sued Bud’s Broiler Holdings and its owners, Melvin and Rebecca Ziegler, in East Baton Rouge civil court. The lawsuit makes numerous allegations against Bud’s Broiler Holdings, including that it violated the franchise agreement with Prince by operating a concession stand at the LSU Stadium in Baton Rouge and at New Orleans' Voodoo Fest. That lawsuit has yet to be heard by a judge.

I would imagine that being forced to buy from one source could be highly problematic. They can charge unreasonable prices.

This doesn't absolve her. She signed the contract.

And she can sue them. There's plenty of case law on this type stuff. The reason that franchises do that is to keep consistency. Most big businesses, food or otherwise, have a purchasing company that operating companies buy for. What Bud's is doing isn't really unprecedented at all. I'm guessing this owner is having to follow rules so doesn't want to so just started doing stuff against the franchise agreement.
