Louisiana Health Care workers mandate

I'm an RN in Louisiana. Our CEO has held out until this week for court clarifications but has announced it. First dose or one dose clot shot mandatory by December 6th. Apparently Senile Joe and the Hoe's mandate deadline approaches and they have no choice or else will lose Medicare/Medicaid funding. Looking for any help with refusal/ exemption forms. I see that the religious one will be easily denied. I understand that they will not fire us but will not allow us to work and basically make us quit. A local cardiologist told a family member of mine to make them fire you and that is your only legal recourse.

Don’t quit, that’s for sure. Maybe you should request your employer pay for a full in depth physical exam for you (above and beyond the normal annual wellness stuff) prior to making a “decision” on the vaccine?

I'm really impressed with the work around Ron DeSantis is coming up with for this in Florida.

DeSantis is seeking to get rid of OSHA for Florida and replace it with a state agency controlled by Florida and by extension, its Governor.

That's the kind of forward out of the box thinking that makes him the best potential GOP candidate for 2024.

Thankfully we are able to get religious exemptions. They are approved with ease.

I can tell you I have a contract with my employer — under that contract I work in a ltc facility.

The facility told me to file an exemption with my employer and if she accepts it, the facility will accept it.

If I request a medical exemption and my employer accepts it, the facility will investigate to make sure it meets the guidelines.

Basically they’re telling me that they know they can’t mess with or question a religious exemption.

File a religious exemption. You are protected by title 7 civil rights act. They must approve. If they deny, ask for reasonings in ink, on paper then threaten with a EEOC complaint. They will change their mind.

I have sauces in several companies that are the people who are approving or denying, one is in healthcare even. Can’t hurt to file it and make it look good. One of my sauces says his philosophy is who am I to say they don’t truly believe this.

Just don’t use a form letter that a local Baton Rouge pastor is handing out. That will get rejected real quick.

Religious exemption

I believe that God gave humans a conscience to help us know right from wrong in a general way, as Martin Luther once said; to sin against conscience is neither right nor safe.
My religious beliefs and practices conflict with the Covid 19 vaccine. God is the creator. I believe that God is the higher authority and trust that in His infinite wisdom created the human body in His image with a body that will efficiently activate our immune system. The Covid 19 vaccine may have the ability to alter my body and immune system with its additives and directly goes against the belief in which as stated before, God has created an efficient immune system. I'm asking for an immediate raise if they enforce it. If they give me the raise I'm going to ask for a signed letter saying that they're legally liable for any side effects it may cause since I'm only getting it for them. If I'm forced to get something for work then they're on the hook for the mandate financially and want to make sure that I have some income if it goes bad I'm not paying for all those myocarditis checkups on my dime when us youngins are at risk for it post jab

File both medical and religious exemptions. When you file religious, make sure you do not state your religion. Not only is it none of their business, but they can poke holes in your religious exemption if they know what you “practice”.

Get your PCP to write a medical exemption. In my experience, I have been successful with medical exemptions proving natural immunity with an antibody test. I have also been successful with cardiac history and/or family history and pulling the VAERS data for proof of side effects (like I said, mostly cardiac and hematologic).

I know it’s stressful. I’m sorry you’re put in this position. It may be difficult to find a provider to sign your medical exemption. I have tried to help as many people as possible by writing exemptions. It’s our right to refuse. Also remember that they cannot afford to lose you. Literally, the hospital can’t. They will likely approve all exemptions, especially if your employer has waited this long to implement something. They are ONLY implementing because of CMS and Medicaid/Medicare, that means they do not want to implement this mandate because they KNOW they cannot afford to lose nurses/hospital staff. This means, they will accept all exemptions. The institution I work for implemented the mandate first in the area and they have not refused an exemption yet. They cannot afford to. Patient care has already tanked in the hospital because of SNAP nurses. There is a reason Mississippi and Texas kicked SNAP nurses out of the entire state.

Stand up for what you believe in. You are doing the right thing. I’ll be happy to answer any questions you have. I do not know everything but I have been writing exemptions for patients for months. I have only had issues with one company and they are not medial.

If you persist in going down this route then you will be fired or not allowed to work and basically be suspended without pay. So you are going to have a legal fight. Here are a few suggestions which will strengthen your legal case.

1. Go to your doctor and discuss it with him or her and get your doctor to order covid antibody titers.

2. Get your most recent employee handbook and turn to their section regarding vaccines for MMR, hepatitis, etc.

3. Get an attorney and pay for the attorney to write a cease and desist letter sent to your employer.

Most hospitals have the policy of allowing employers to get their titers against those viruses checked regularly at company expense instead of getting another round of vaccines. The hospital I work at changed its policy for flu vaccine, and made it mandatory just like covid, but they did not change the policy regarding all vaccines. If you can prove that you have good antibody titers against covid then you can get a doctor (unless he or she is in the get the jab or die camp) to sign a document saying that there it is not medically necessary to be vaccinated. If your company still allows getting your titers checked regularly at company expense as an alternative to vaccination or getting a booster for those viruses but not for covid then get your lawyer attorney to send a cease and desist letter before they realize the omission and change their policies. No doctor is going to get involved in your company's policies because that is not our job, but we will sign off a document saying you have sufficient immunity if we have the proper lab work to back us up. If you have documentation from your doctor saying that you have sufficient immunity and your employer has been served a cease and desist letter while their policies still allow you to have your titers checked as an alternative to vaccination and they still fire you or keep you from working then your attorney will be able to go HAM on their arse.

If I felt as strongly as you do then I would try for the religious exemption if I were you. The federal government will press you hard and/or reject so you are SOL if you work for the VA or are in the military. However, no private employer is going to risk a religious discrimination lawsuit especially if you have an attorney write your religious exemption and not that BS example that has been posted on here (not saying the BS example is not good enough but I would want something stronger if my livelihood was on the line).


ETA: I personally think your position is f**king stupid, but I support your right do things that others think are f**king stupid without losing your job.So I wish you good luck in your legal fight even though I think your position is f**king stupid.

The religious exemption is easier to get. Go the route of abortion and fetal cells. All 3 used fetal cells in the research and development.

Read title VII of the EEOC on religious exemption.

Medical exemption will be harder to get approved. I hate how the govt has put us in this situation.

I went the fetal cell line route for my covid vaccine exemption. It was super long and very detailed. It was denied twice, then approved once I threatened an EEOC complaint for religious discrimination. They said since the Archbishop in New Orleans wasn't against vaccines, they had a right to deny my exemption as a Catholic.

For the flu vaccine exemption, I typed a single paragraph basically quoting scripture about how I'm made in God's image, how I must obey no other governing body apart from Him, and said that I had prayed to God and He told me not to get the vaccine. They approved that one no problem.

Go the generic as possible route.
