If you have documented proof of sober consent should they still be able to press charges?

Say a dude gets in your face acting all tough and says something like “hit me motherfricker, I dare you, I want you to hit me…”

Battery is a touching w/o consent. People can agree to fight and it’s legal, but usually the arse whippee will lie and say no consent.
