This one is the lesser of the two and they have CNN dead to rights in the 1st one lying and in the second misleading. Either way, the 1st lawsuit is completely illegal. False. She pointed out that CNN polled adults and not registered or likely voters. She also pointed out that only 24% of the respondents were republicans (which is not representative of the voting population). Stelter talked over her throughout.

I'm not a lawyer, but it seems as though she was by basically making the point, that by CNN defining their results as a "Poll" they were misrepresenting the information as having been collected and collated according to a defined standard.

Stelter is a chode, but I feel it’s relevant to point out that Ellis never really answered his question. He asked what basis they could sue on and she rattled off a bunch of ad hominems and non-sequitors along with vague accusations of flawed polling procedures. She never offered any evidence or concrete legal claims.
It was funny to be sure, but there wasn’t much substance at all.

If they were a platform they would be protected from their users 'post'. but because they exercise editorial control they can be sued for libel.
The suit does double duty though, since I think this is a not so subtle signal to the social platforms that they really don't want to go down CNN's road. Editing changes their platform into a production that they are legally responsible for. They could then be sued by literally every Karen in the world, it would be a legal feeding frenzy that twitter, google, and facebook, really don't want.
