If you do get stopped, agree to do the field sobriety tests but then say that you are pretty sure you have a medical condition that will affect your test results. When the officer asks what the condition is, ask if he can provide a complete list of conditions that can impact testing. He won’t be able to and say that you aren’t qualified to give a medical opinion either. Keep saying that you want to take the tests but only after consulting with a medical professional.

If they keep pestering you about the condition, tell them that anything you say will be captured on his bodycam and will also appear in the police report so it will be easily discoverable by anyone who makes a public records request. You value the privacy of your personal health information and discussing your condition would violate rights like those in HIPPA.

If the cop keeps pushing the tests, ask why he won’t cooperate and comply with your requests. When they bring out the Breathalyzer or blood draw equipment, run. They’ll probably be happy to see your pain in the arse self leave and won’t pursue you.
