I had a client who ran a junkyard. He was structuring deposits (keeping them under $10,000 which is not illegal) because he is an old man who thinks shite shouldn’t be reported to the government.

He did nothing wrong.

DHS came in with a warrant and seized close to $300,000. He had to prove his innocence, not the other way around, and sue to get most, not all, of his money back.

Civil asset forfeiture is horse shite.

Actually, structuring is illegal. I understand his stance though.

Title 31 Section 5324

(a)Domestic Coin and Currency Transactions Involving Financial Institutions.—No person shall, for the purpose of evading the reporting requirements of section 5313(a) or 5325 or any regulation prescribed under any such section, the reporting or recordkeeping requirements imposed by any order issued under section 5326, or the recordkeeping requirements imposed by any regulation prescribed under section 21 of the Federal Deposit Insurance Act or section 123 of Public Law 91–508—

(3) structure or assist in structuring, or attempt to structure or assist in structuring, any transaction with one or more domestic financial institutions.

this dude WASN'T a criminal, as he had a valid prescription, and there was no charges against him, yet they still took and kept (and probably spent) his money...

that's just straight up robbery...

If it keeps just one teenager from getting hooked on pot it’s worth it in my opinion.

How can you people put a price on our children’s safety?

Being guilty of past crimes doesnt make you guilty of all future accusations, nor does it mean the state can steal from you whatever it wants.

he wasn't charged with anything, nor was there anything about an outstanding warrant...

are you trying to say the cops are justified in taking his money because he may have had previous arrests? you have a TRULY fricked up sense of justice and punishment, if so...

Deliberately keeping deposits under 10k is most definitely illegal. It’s a felony on the federal level.

Doesn’t justify CAF though.
