When one of the women asked whether they were being detained "because of our profiles," O'Neal replied, "No, it has nothing to do with that. It's the fact that it has to do with you guys speaking Spanish in the store, in a state where it's predominantly English-speaking, OK?"

They did. He still took them to his squad car and detained them so he can call into dispatch for some sort of verification.

He said that knowing full well that they were recording him. You would think that would have given him pause, but no.

In the video the woman never asks why or if they are being detained..she asks why they were asked for ID.

I agree. Where do they get off asking a question like that?

He didn’t take them to his squad car..they walked or rather slid their feet over to it of their own free will..did you even watch the video?

To me, this isn't even being detained. It was being questioned. I've been stopped and questioned a few times and I just answer the questions and be on my merry way. No big deal.
Now, I was detained in Hong Kong airport for about 8 hours. Questioned and released. Of course, I forgot about the 9MM magazine (empty) that I had in one of my bags so understood that one as well.

Try to refuse to show a cop your ID. Let me know how that goes

If a cop wants my ID for no apparent reason when I am walking in a parking lot, it will go very very well for me.

take it that you don't know that Havre, MT is within 10 miles of the US border? In fact, the first "town" that you would get to if you illegally crossed the border in that area. And the very reason that a border patrol agent would be in that community, checking for illegals

To be fair CBP is allowed to verify immigration status and detain for a reasonable amount of time... 40 minutes is not reasonable.

Had they not been citizens you would have a point.

Dawgfanman, come on. The guy had their license at that point.

Slid their feet over to it?

Not cool.

Under color of the law is not under free will.

Its depressing to think that many people have died for rights you dont think they have.

“Am I being detained or am I free to go?” This will either result in you not having to show ID or you being told you are detained. If you are detained and they didn’t have reasonable suspicion to do so, it’ll make the lawsuit easy. This isn’t difficult. More fun is to refuse to show your receipt when leaving a store that checks. Who the frick do they think they are to have the right to rifle through my groceries? They stopped being their groceries when I paid for them. They want to look at them now, they can pay me.

After watching the video I don't see a problem with the officer's behavior, he explained it to them very carefully and reasonably. The "40 minutes" HAS to be extremely exaggerated.

To be honest, their accents are UNUSUALLY thick for being born in the US and would raise my suspicion at first as well. This is a BP agent, whose job it is to find illegal aliens with often fake documents. Not to mention this is somewhere that Hispanics are uncommon.

I wouldn't have questioned them long enough to last 40 minutes or anything, but the thickness of their accents would give me pause against the claim of being born in the US. I've been in a similar situation as this officer and can say that it's very hard to handle it any better than he did.

The question still remains if he should've ever asked them for ID to begin with, but his actions after that aren't anything to be upset about.

Watch the video. I hate that shite. My own kids do it on the hardwoods and it bugs the shite out of me.

Look, the guy was wrong but I’m a white male and same shite has happens to me. They didn’t do a damn NPR story and I didn’t get a fat check from my fellow citizens. People need to learn to stand up for their rights and deal with cops like they would any other human. I wouldn’t have given that guy my ID. If he has reason to need it he should be patting me down and taking it.

Would you feel better if we used a baseball term like Sabremetrics?

Criminalmetrics.

Because they're just using stats...and real world experience.

Instead of WAR, a cop can look at someone driving in a low-rider, with a bandana on and neck tat and calculate POP, probability of prison.

Then go ahead and send them whatever they are trying to take out of our pockets via the courts. You probably stay pissed off.

If it were you getting singled out, I'd feel the same way. Would you?
