National Public Radio Article

Ana Suda and Martha "Mimi" Hernandez — American citizens who were born in Texas and California, respectively — were questioned as they attempted to buy groceries in Havre, Mont., last May. They captured video of the encounter, which began inside the Town Pump gas station and convenience store. In all, they were detained for some 40 minutes.

In the footage, CBP Agent Paul O'Neal is seen telling one of the women, "Ma'am, the reason I asked you for your ID is because I came in here, and I saw that you guys are speaking Spanish, which is very unheard of up here."

When it was posted last spring, the video raised new questions about the Trump administration's methods for carrying out a crackdown on people who have entered the U.S. illegally from the southern border. Suda and Hernandez say the agent had no cause to detain them; they accuse the CBP of violating their rights against unreasonable seizure and equal protection under the law.

quote:

The two friends have lived in Havre for several years, working as certified nurse assistants at a local medical center and raising their children in Montana, according to their lawsuit. They say they had left work, gone to the gym, and were waiting to pay for their milk and eggs when Hernandez said hello to O'Neal in the checkout line — and that he replied by saying she had a strong accent.

He then asked the pair where they had been born — leading Suda to ask, "Are you serious?"

"Dead serious," O'Neal responded, according to the suit.

Suda told the agent she had been born in El Paso, Texas; Hernandez said she was born in El Centro., California. But that didn't satisfy O'Neal, who "demanded that the two provide him with identification and refused to let them pay for their groceries" until they complied, the suit states.

Wait, you can sue a border patrol agent for doing his job?

Does that go for an IRS agent too?

I like things that work.
Profiling in NYC reduced crime rates.

You can sue when they infringe on your rights.

Would you prefer we search the old black lady in the wheelchair at the airport or the military aged male in the Muslim outfit?

I'd prefer that people aren't harassed for no reason other than speaking Spanish.

It must be nice to also be born here but never getting needlessly detained as you go about your every day business. What's that privilege like?

There was a time when profiling was called another name - intelligent detective work.

Why is it people refuse to show their ids?

Look out Jbond, that walmart worker is going to ask for your receipt.... you better put him in his place and yell about your freedoms!

But that didn’t happen..anymore than a police officer or other law enforcement agent questioning someone acting abnormally for any other reason.

LoL, wut?

I take it that you don't know that Havre, MT is within 10 miles of the US border? In fact, the first "town" that you would get to if you illegally crossed the border in that area. And the very reason that a border patrol agent would be in that community, checking for illegals.

How stupid

What’s wrong with noting that illegals are way more likely to not speak English?

Cheech Marin had a funny movie on this premise back in the 80s.

It was about his travails of being locked up and deported. Now it would be about getting paid just for the audacity to question him.

It's weird that you think the two are remotely comparable.
