An article today referenced money that “was not spent for authorized foundation purchases.”

Sometimes(SVU just did an episode with this scenario) a manager with authority to pay bills will authorize payments for services/consultant fees to a company in which he/she is a silent partner of or connected to.
This is a common method of embezzlement and hard to catch in an audit if the bad person is careful aka not greedy. Inflating the payments or double and triple payments are dead giveaways.

He’s not going to do jail time. Guys with his money and his connections don’t go to jail for white collar crime like this. Probation and restitution.

There are a bunch of minimum security federal prisons across the country full of people that had way more money and connections than this guy.

this and if he wired any money out of state or did not report as income or had a bank account out of state or drove across state lines with money he will do years. All federal crimes and no matter who he knows Fed judges have no sense of humor about any of that. Also, it was from a Children's Hospital. I do not know details but as someone in the legal business for 30+ years I can assure you if any of above proves true, he is gonna do a lot of other people's laundry for years. Also, as other have said $ does not matter other than how many of his assets get taken to pay back OLOL. If his house is in wife's name it MIGHT not get taken, but if she had any reason to know anything and did not turn him in, she's gonna lose it all too (NOT saying she knew anything, again know no details on any of this case.

I think there should be a non-compete agreement of sorts in these situations where the guy who was prosecuting white collar crimes ONE YEAR AGO ago is now DEFENDING the criminals he was so proficient at putting away.

If you're not sure what I mean, Funes hired Walt Green, former US Attorney who recently sent a local Network Admin to 34 months in prison

You'd think that If hacking a plant under the evil Koch Brothers Umbrella will get you almost 3 years, I Imagine stealing from a Childrens Hospital will yield even harsher sentence.

Good people make bad decision from time to time.

While I certainly agree with that statement, this appears to have been well thought out, calculated and apparently he knew he could take advantage of the OLOL's checks and balances system ... until the checks and balances system (whatever that is for them) caught up to him.

One can easily claim addiction and that may have well be the case here, but it does not justify what he allegedly did to OLOL and the people who donated to OLOL.

His actions should have consequences and not just a slap on the wrist. This is a serious misuse of trust and fraud.

What did this guy do with all that dang $? It’s not like he lived an extravagant lifestyle. Yeah- private school tuition and a stay at home wife but nothing too extreme.

Doesn’t the Fed Court System still have sentencing parameters judges are bound by? I think the plea deals in a case like this relate to the amount of ‘damage’ caused by the theft, and can be reduced by paying it back before the Train leaves the station

Let’s say he was able to quickly liquidate and pay back all but $150K of the money, sentencing recommendations may be based on the lesser amount. Judge still has final say, but it reduces the length of incarceration.

He better pray this ends up Federal, because he’d last about 5 minutes housed in General Population in Hunt Correctional.

May have put $$ in overseas accounts just in case he got caught. He knows he would have access when he gets out of prison.

The grandson of a former state senator is currently doing time for manslaughter as a trustee at the state police barracks. Presumably this guy is at least as well connected

Or a gambling habit.

Or it’s going up his nose.

Or some combination of all 3. It’s usually going to be at least one in cases like this.
