Actually you’re not. You’re charged with something else and it’s less severe, which is kind of the point. There’s absolutely no crime on earth that you get the same severity of punishment for conspiring to commit and actually committing.

People have gotten shorter prison sentences for 2nd degree manslaughter with a firearm. Normally I’m all about doing your time, but this is extremely excessive. He should not lose half of his career over what happened. 1 year, fine. 2 years is entirely too much considering the crime

It is a very very odd situation. Did KF submit a tampered sample?

He tried to but was caught. Then he destroyed the tampered sample.

quote:

So what the NCAA is actually saying is that Intending to tamper or considering it, but changing your mind and doing the right thing

To call that a stretch of the truth is being kind.

quote:

Further, if Fulton was caught
he was. This was in the story.

quote:

and if the rules were clear to him
they weren't. This was addressed in the story, and his action to try and cheat on a test that didn't even test for Marijuana supports that.

quote:

why then submit his own sample at all?

Many simple answers to this. His options were limited. Maybe he thought submitting a sample and hopefully passing were better than the alternative. Maybe he knew the punishment for refusing to give a sample.

quote:

Something simply does not add up. The suspension is two years for "tampering". It is one year for a failed test. The claim is Fulton was caught tampering. So why at that stage would the evidence collector even proceed with the test?

The evidence collector isn't enforcing NCAA rules. It is following procedure on testing. Their job is to collect the sample, assure that the sample is coming from the right source, submit it for testing, and report on the entire process.

quote:

For those here basically saying "rules is rules", you need to back it up a skosh and understand also that right is right, and this is not right.

The only thing I think that is not right, is the length of the suspension. 2 years is a huge amount of time. Other than that, I really don't have a complaint.

quote:

In the end, the evidence Fulton supposedly tampered with was actually his own untampered sample.
Can't do anything but just laugh at that.

quote:

He never submitted a tampered sample. Did he?

He was caught. He was prevented from doing so.

quote:

Again, this seems an open invitation to suit
maybe

Look, there very well could be legal action here. But, they don't really make sense even if they will rule the day. It's pretty clear what the NCAA policy is and what the expectations are. And, Fulton is being punished accordingly. Now, if the NCAA didn't dot an i or cross a t and Fulton is going to be able to play, I'll take it. Hell, our competition will try to get the same advantage at every turn. But, you fail when you try to suggest that Fulton is right in this. He's not. He admits to doing everything he's being punished for.

The best approach would be to focus ONLY on the punishment. This needs to be an attack on the NCAA to point out that a draconian punishment like that is NEVER in the best interest of the student.

Orgeron needs to decide to take a public stance on the issue. He needs to take the side of the player. He needs to go scorched earth. He needs to play the "it's just wrong" card. He needs to point out that a 2 year punishment effectively removes a second chance. This will be a win for Orgeron. He'll be seen as a proponent for the player. He can use it in recruiting. And, taking on the NCAA gives instant credibility as to his stature. SEC media days would be perfect for this, but I don't know if that timeline works.

This will get the attention. As of now, nobody has even noticed this story. Ultimately, I don't think it will solve the problem, though. In the end, you are still asking the NCAA to admit that its policies are wrong and to remedy it in a specific case. I don't think that's going to happen.

the punishment is way overboard, but why do something stupid to put oneself at risk the way he did?

shouldn't be smoking weed when he knows it's against the rules. complete boneheaded move on fulton's part, though i think he's more than paid for his blunder.

Look I think the punishment is ridiculous and draconian but let's not pretend that Fulton is innocent here.

He did the crime and imo he's done enough crime. One year suspension is more than sufficient

Bone, I can’t speak for everyone on this board but I just wanted you to know that at least myself (and I believe the majority of tiger fans) fully support Kristian and your family through this situation.

Don’t listen to the dumbasses. I know your son isn’t stupid, he just made a stupid mistake. Anyone who has kids has seen their kid make a dumb mistake, it’s just unfortunate that your son had to learn his lesson on such a large stage.

The kid obviously isn’t running from his mistake either which is extremely respectable in my book. He easily could have transferred to JUCO and prepared for the draft but he didn’t. He chose to stick it out and fight for his second chance as a tiger.

We all hope that the NCAA sees how extreme the punishment is, sees that the kid learned his lesson, and let’s the boy play.

However it turns out, know the tiger nation is behind y’all.

Thanks we appreciate the support. This has been extremely difficult and my son doesn’t want sympathy. He works extremely hard on and off the field.

Weed being illegal is stupid in the first place, and good luck finding very many college kids who didn’t try it or don’t do it. I did a lot of crazy things in college. It’s part of being a college kid IMO. Tampering with the test should be considered a “positive” test...no more, no less...and he should serve punishment for that. Which he did. Plus some. End of story.
The NCAA does and has done many many many many things that didn’t add up in the law of common sense. This is one of them.

I think this is where a vast majority of folks are including Kristian and Mudbone. No one thinks he shouldn't be punished. It's the disparity of the punishment handed down that is at odds. The NFL and MLB do not differentiate between cheating and a positive test. They are penalized the same and are a fraction of what the NCAA does. Part of the problem is the student athlete does not have a representative agency like professional athletes do with NFLPA and the MLBPA. There is no oversight or counter-balance to the NCAA. They operate without impunity.

then there's no disincentive to tampering if a guy thinks he'll fail the test. Then tampering will become commonplace, which would be a disaster.

Ok idiot number 2 I’m fine with you being critical of his mistakes. But calling my son a idiot I’m going to defend him. You only know the person you read about I know his heart. Kristian will be ok with your support are without. Be blessed and hopefully your kids never make a mistake.

NCAA message to student athletes. Rape a 6 year old and have a chance to play sports. Attempt to cheat on a drug test two year suspension.
