Damn, so the guy comes home to find 2 men have broken in and his wife is home alone. They smash him with a hammer, fracturing his skull, and order him to open the gun safe. They take his guns while the wife flees to the neighbors.

Then this dude, with a fractured skull, grabs his other pistol from another room and goes outside to find his wife. Runs into the robbers and kills one while the other drops the guns and flees.

Pretty solid work

ETA: oh and their house was robbed before and a TV was stolen. Our dead perp is a suspect in that case.

The guy that dropped the guns and ran, if caught, will be charged in the dickheads death I think. Someone correct me if wrong

I think in some instances you can do it but it’s pretty difficult to get a conviction.

This is the problem. This guy should have been in prison instead of out breaking into homes and hitting people in the head with hammers. I'm glad this POS is dead, but the judge that gave Adams probation is a POS also.

If someone dies while you are committing a felony, you are guilty of felony murder in most jurisdictions

Definitely as long as the dudes who fractured your skull with a hammer were armed with rifles.

Good luck find a jury, criminal or civil, that would rule against a guy under these circumstances.
