Looks like they told the principal (and I assume showed him the footage) and the principal didn't report it to the cops.
If this is true what the hell are they charged for?

The mother told police she ultimately spoke with Shane, who described seeing the footage, emailing it to herself, and deleting it from the phone of the boy who recorded it before giving the phone back to him. Shane, 27, also said she had sent the footage to Kusmirek, 32, according to the mother.
And here is your problem

Well, this quote from the principal could come back to bite him in the arse.
quote:
"It's a declaration of war on teachers who are on the front lines of the school-to-prison pipeline we see in this city."
He's basically admitting that they have an incentive for not reporting the potential rape of a student because it could get these students in trouble with the legal system. That principal shouldn't have been speaking with the press.

One teacher found the video on the phone of a student and emailed it to herself then forwarded it to another teacher. That's why they're getting possession of child porn charges.

So, black lady saves it and emails it to white lady and white lady gets charged?

Yeah, I think that's how these laws work in many states.
If a 16 year old boy gets a random titty pic from his 16 gf, then he's considered to be in possession of child porn.
IIRC, there was a case in another state where a minor girl was charged with possession of child porn because she had a selfie of herself naked on her phone.

Ummm, failing to report the potential/alleged sexual assualt that occurred at his school SHOULD come back to bite him in the arse.

Yeah, I'm not sure what the laws are regarding that stuff, but I'm surprised he hasn't been arrested for his involvement in this as well if he never reported it to the cops.

I would think normal people after witnessing sexual assault on a phone video would confiscate the phone and call police...

Fo real
Charging them with possession of child porn is absolutely ludicrous, unless there is some action by them were are not being told about, like putting it on the internet, etc.

Meanwhile Roman Polanski and Woody Allen are still making movies and receiving standing ovations from Hollywood

I think that principal needs to shut the frick up. He is probably the reason the teachers got charged since he showed up to meet Detectives with his own lawyer in tow. Here is another gem from him:
quote:
"In our opinion, they took appropriate action and protected the interests of our school and the safety of those students," said the principal, adding that an internal investigation found no violations of procedure on behalf of the staffers.
So let's see how that plays to a jury. Interests of the school before students? Check. Investigated yourselves and cleared yourselves? Check.

Does this fit the bill for conspiracy charges?

Pretty sure you don't qualify. Sorry

All of these teachers should know (because they should be taught) that when you come across something like this you STOP immediately and call the school's attorney (or an attorney for the teacher's union). You DO NOT try to handle a potential CRIMINAL action on your own.
